Terms of Use
Last updated 29 October 2026
Last updated: 26 October 2026.
1. About these terms and AutoCart
1.1 These Terms of Use ("Terms") are an agreement between you and AutoCart Technologies Ltd ("AutoCart", "we", "us"), a company registered in Ireland with company number 824969, whose registered office is at 34 Clós na Manach, Carlingford, Co. Louth, A91 YV59, Ireland. You can contact us at support@autocart.ie.
1.2 These Terms apply when you use the AutoCart app or our websites autocart.ie and auto-cart.co.uk (the "Service"), whether or not you have an account. By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.
1.3 Our Privacy Policy, at https://autocart.ie/privacy, explains how we handle your personal data. Sections 9 and 11 contain extra terms for paid services and for trade and brand accounts.
1.4 AutoCart is an online marketplace where people and businesses in Ireland and the United Kingdom advertise vehicles, parts and related items, and buyers find and contact them. We provide the platform only. We are not the seller or buyer of anything listed, we are not an agent for either side, and we do not take part in any sale.
1.5 In particular, we do not:
- inspect, own or hold any vehicle or item listed
- check that every listing is accurate or lawful, although we review listings before they go live
- handle payment for any vehicle or item, or hold money on anyone's behalf
- guarantee that a seller, buyer or sale is genuine
1.6 Any sale is a contract directly between the buyer and the seller. Buyers should carry out their own checks before paying, including a vehicle history check, an inspection and a test drive. See section 4 and our safety tips in the app.
1.7 Some words have a particular meaning in these Terms:
- "Private seller" means an individual selling their own vehicle or item, not as part of a business.
- "Trader" means anyone selling as part of a trade, business or profession, including dealers, garages and dismantlers. Trade accounts and brand accounts are for traders.
- "Listing" means an advert for a vehicle, part or other item.
- "Content" means anything you post or send on AutoCart, including listings, photos, videos, stories, captions, profile details, messages and reviews.
2. Who can use AutoCart
2.1 You must be 18 or over to create an account or to use AutoCart.
2.2 AutoCart is for buying and selling in Ireland and the United Kingdom. Listings must be for items located in Ireland or the UK.
2.3 There are three types of account:
- Private account: for individuals buying, or selling their own items. You must not use a private account to sell as a trader.
- Trade account: for dealers and other traders selling vehicles or parts as a business.
- Brand account: for vehicle manufacturers, brands and their authorised dealer locations.
2.4 When you create an account you must give accurate, complete information and keep it up to date. You may have only one private account. Keep your password secret and tell us straight away at support@autocart.ie if you think someone else has used your account. You are responsible for what happens on your account.
2.5 If you open a trade or brand account, you confirm that you are authorised to act for the business and to accept these Terms on its behalf. We review trade and brand applications before approving them, and we may ask for more information or documents, or refuse an application. While we review it, your listings may be held for approval.
2.6 A "Verified" badge on a trade or brand account means only that we have reviewed and approved the business details and documents provided. It does not mean we vouch for the business, its vehicles or its conduct.
2.7 You can browse and search AutoCart without an account. These Terms still apply to you.
3. Listing rules
3.1 You may only list a vehicle or item that is located in Ireland or the UK, that you own or are authorised to sell, and that is available for sale.
3.2 Your listing must be accurate and must not mislead buyers. In particular you must:
- describe the vehicle or item honestly, including its condition and any known faults
- give the correct registration number, mileage, year and specification
- use photos of the actual vehicle or item
- state a genuine price in euro or sterling. For traders, this must be the full price including any mandatory fees, such as admin or preparation fees
- only describe a price as reduced if the earlier price was genuinely charged
3.3 You must disclose clearly in the listing if any of the following apply:
- the vehicle has been declared a write-off or salvage by an insurer, and its category (for example Category S or N in the UK)
- there is outstanding finance on the vehicle
- the mileage is not genuine, or is unknown
- the vehicle has been imported
- the vehicle has been used as a taxi, hire or rental vehicle, or by the emergency services
- the vehicle has significant accident or flood damage
3.4 You must not list:
- stolen vehicles or parts, or anything you believe may be stolen
- vehicles whose identity has been changed, cloned or hidden, including altered vehicle identification numbers (VIN) or registration plates
- vehicles with a tampered or "clocked" odometer
- vehicles that cannot legally return to the road, such as Category A or B write-offs, unless they are clearly listed as parts only
- devices designed to defeat emissions controls, alter mileage readings or remove safety features
- weapons, drugs, counterfeit goods, or anything else illegal to sell
- anything other than a genuine item for sale, such as loans, services, job adverts or links to other marketplaces
3.5 One listing must cover one vehicle or item. Do not post duplicate listings.
3.6 If you are a trader, you must use a trade or brand account, and you must not pretend to be a private seller.
3.7 We review listings before they go live. We may refuse, remove or ask you to change a listing that breaks these Terms or the law, or that buyers report as misleading.
3.8 Listings from private accounts stay live for 30 days unless you extend them. Listings from trade and brand accounts stay live while your account and plan allow, until you remove them. Mark a listing as sold, or remove it, as soon as the item is no longer available.
4. Buying and selling
4.1 Every listing shows whether the seller is a private seller or a trader, based on the account type the seller chose. If you buy from a trader, you have legal rights as a consumer, such as the right to goods that match their description and are of satisfactory quality. Most of those consumer rights do not apply when you buy from a private seller.
4.2 The buyer and the seller are each responsible for their side of a sale, including the price, payment, paperwork, transfer of ownership, insurance and tax. AutoCart is not responsible for whether a sale goes ahead, or for the condition, safety, legality or description of any vehicle or item.
4.3 To stay safe, we strongly recommend that you:
- see the vehicle in person, at the seller's address or a trader's premises, before paying anything
- check the registration document and the vehicle identification number (VIN) match the vehicle
- carry out a vehicle history check, including for outstanding finance and write-off records
- never pay a deposit to "reserve" a vehicle you have not seen, and never pay by money transfer to someone you have not met
- be wary of anyone asking you to communicate or pay outside AutoCart, or offering "delivery agents" or escrow services
AutoCart never holds payments, never offers an escrow service, and will never ask you to pay a seller through us.
4.4 If you receive another user's details, such as their name, phone number or email address in an enquiry or message, you may use them only to deal with that listing or sale. You must not add them to marketing lists, share them or use them for any other purpose.
4.5 You are responsible for any personal data you include in your listings and messages. Do not include other people's personal data, such as faces, names or the registration numbers of other vehicles, unless you have the right to.
4.6 Vehicle details we show from registration look-ups come from third-party data providers. They may be incomplete or out of date. They are not a full vehicle history check.
5. Your content
5.1 You keep ownership of the content you post. You give us a non-exclusive, royalty-free licence, valid in every country, to host, store, copy, adapt (for example resize, compress, crop or convert), display and distribute your content, for the purposes of running, improving and promoting AutoCart. This includes showing your public listings and stories in AutoCart's own social media posts and adverts. The licence ends when you delete the content or your account, except for copies we must keep under section 10 of our Privacy Policy, and content other users have already shared.
5.2 You confirm that you own, or have permission to use, everything you post, including photos, videos, music, logos and text, and that posting it does not break anyone's rights or the law.
5.3 Only add music or other audio to a story if you have the right to use it. We may mute the audio of a story, or remove it, if we receive a copyright complaint or believe the audio infringes someone's rights.
5.4 To the extent the law allows, you agree not to assert any moral rights in your content against AutoCart, such as the right to be named as the author, when we use it as these Terms permit.
5.5 AutoCart's name, logos, app, websites and design belong to us or our licensors. You may use the Service only as these Terms allow. You must not copy, scrape, harvest or reuse listings, profiles or other content from AutoCart by automated means, or build a database from them, without our written permission.
5.6 If you send us suggestions or feedback, we may use them without paying you or owing you anything.
6. Community rules
6.1 AutoCart has zero tolerance for objectionable content and abusive users. You must not post, send or share anything that:
- is illegal, or promotes or helps illegal activity
- sexually exploits or abuses children, or sexualises anyone under 18
- is sexually explicit, or shares intimate images of anyone without their consent
- promotes terrorism or violent extremism
- threatens, harasses, bullies, stalks or intimidates anyone
- attacks people because of their race, ethnicity, nationality, religion, gender, sexual orientation, disability, age or any other protected characteristic
- encourages self-harm, suicide or violence
- is a scam, phishing attempt or fraud, or asks for payment in a way designed to deceive
- impersonates another person or business, or misrepresents who you are
- is spam, chain messages or unsolicited advertising
- contains someone else's personal data without their permission
- infringes someone else's copyright, trade mark or other rights
- contains viruses or harmful code
6.2 You must not:
- use AutoCart to contact people for any purpose other than buying or selling
- post fake reviews, or reviews you were paid or rewarded for without saying so
- create accounts by automated means, or create a new account after we have suspended yours
- interfere with the Service, test or bypass its security, or overload it
- use bots or automated tools to access the Service, unless we have agreed in writing
6.3 Use the block feature to stop someone contacting you. Use the report feature to tell us about content or users that break these rules (see section 7).
6.4 If you break these rules, we may remove your content, limit your use of AutoCart, suspend or close your account, and report illegal activity to the police.
7. Reporting, moderation and complaints
How to report
7.1 You can report a listing, story, profile or message from the report option in the app. Anyone, including people without an account, can also report content by emailing support@autocart.ie with a link to it or its ID.
7.2 If you believe content is illegal, choose "Illegal or unlawful content" and tell us why you believe it is illegal, where it is (for example the listing link), and your name and email address. You do not need to give your name if you are reporting child sexual abuse material. Please only report in good faith.
7.3 We confirm when we receive a report, review it promptly and tell the person who reported it what we decided. We aim to act on reports of objectionable content within 24 hours. The person you report is not told who reported them.
How we moderate
7.4 We use a mix of people and automated tools:
- Listing review: our team reviews new listings, and changes to live listings, before they appear.
- Word filter: an automatic filter checks names, listings, stories and captions against a list of offensive words and blocks them, and hides those words in messages.
- Reports: our team reviews every report.
Decisions to remove content, restrict a listing's visibility, or suspend or close an account are always made by a person.
7.5 If we act against your content or account, we tell you in the app or by email what we did and for how long, why, whether it followed a report, whether automated tools were involved, which rule or law it was based on, and how you can ask us to reconsider.
7.6 We may report content or activity to the police where we believe someone's life or safety is at risk, or where the law requires it.
Appeals and complaints
7.7 If you disagree with a decision we made about your content or account, or about something you reported, you can ask us to look again within 6 months by replying to our decision email or writing to support@autocart.ie. A different member of our team reviews it, and we tell you the outcome and the reasons.
7.8 You can also complain to us at support@autocart.ie about how we deal with illegal or harmful content, or if you believe we have not followed these Terms. If you are in the UK, this includes complaints about how we meet our duties under the Online Safety Act 2023.
7.9 Our single point of contact for users, and for authorities in the EU and the UK, is support@autocart.ie. We can communicate in English.
8. AI features
8.1 AutoCart's AI features can suggest vehicle details and descriptions from your photos and notes, read registration numbers, and turn a search sentence into search filters. They are optional.
8.2 AI can make mistakes. Before you publish a listing, you must check every detail the AI suggested and correct anything that is wrong. You are responsible for your listing, including anything the AI wrote.
8.3 AI search results are suggestions. They may leave out listings that match, or include listings that do not.
8.4 Only upload photos and text you have the right to use, and do not include other people's personal data in your notes.
8.5 You must not try to make the AI features produce content that breaks these Terms, or use them for anything other than creating listings and searching AutoCart.
9. Paid services
What's free and what's paid
9.1 Browsing, searching, messaging and listing from a private account are free. Private accounts can post up to 3 new listings a day.
9.2 Trade and brand accounts need a monthly plan to publish listings. The plans, what each includes and their prices are shown in the app before you buy. Prices include VAT where it applies.
9.3 Anyone with an active listing can buy a one-off boost:
- Extend: keeps a listing live for an extra 30 days.
- Spotlight: gives a listing priority placement for 20 days, marked with a Spotlight label (see section 10). It also extends the listing if needed.
Free trial for trade and brand accounts
9.4 New trade and brand accounts get a free trial of the Starter plan. The trial length is shown in the app when you sign up. We do not take payment details for the trial, and it does not turn into a paid plan automatically. When the trial ends, you need to choose a paid plan to keep your listings live and publish new ones. If you subscribe during the trial, the trial ends and your paid plan starts straight away.
Paying, renewing and cancelling
9.5 You pay for plans and boosts through the Apple App Store or Google Play, using the payment method in your store account. The store's own terms apply to the payment.
9.6 Plans renew automatically each month at the price shown, unless you cancel at least 24 hours before the end of the current month. You can cancel at any time in your App Store or Google Play account settings, or from Purchase History in the app. Deleting the app or your AutoCart account does not cancel your plan. After you cancel, your plan stays active until the end of the month you have paid for.
9.7 If we change a plan's price, we will tell you at least 30 days in advance. The new price applies from your next renewal after that, and the store may ask you to agree to it. If you don't want to pay the new price, cancel before it applies.
Refunds
9.8 Refunds for purchases made through the App Store are decided by Apple. You can request one at https://reportaproblem.apple.com.
9.9 If you cancel a plan bought through Google Play during your first paid month, we will refund that month in full on request. Your listings are removed when the refund is made. After the first paid month, plan payments are not refundable, except where the law or the store's rules require.
9.10 Boosts start as soon as you buy them, and cannot be moved to a different listing. If you are a consumer, the law gives you 14 days to cancel a purchase of a digital service. By buying a boost, you ask us to start it straight away, and you accept that once the boost has been fully provided you lose the right to cancel. If you cancel within 14 days while a boost is still running, you may be entitled to a partial refund, which Apple or Google will process.
9.11 We do not refund plans or boosts if we remove a listing or suspend an account because it broke these Terms. This does not affect your legal rights.
10. How listings are ranked
10.1 This section explains how we decide the order of listings and stories, and how payment affects it.
10.2 When you search with words, listings are ordered first by how well they match your words and filters. Among equally good matches, the order follows the rules in 10.3.
10.3 When you browse, or choose the default "Best matches" order, listings are ordered by these factors, most important first:
- Spotlight: listings with an active paid Spotlight boost come first.
- Pro plan: listings from trade and brand accounts on the paid Pro plan come next.
- Your interests: if you are signed in, listings in the categories you have viewed, liked and shared most recently are moved slightly higher.
- Newest: within each group, newer listings come first.
10.4 If you choose another order, such as price, newest or nearest, listings are ordered only by what you chose, and payment has no effect.
10.5 Some sections show only paid Spotlight listings, chosen at random and changed every 10 minutes. These sections, and each Spotlight listing, are marked "Spotlight" so you know they are paid placements.
10.6 Apart from Spotlight and the Pro plan, nobody can pay to improve the position of a listing.
10.7 Stories are shown newest first, except in Trending, which shows the stories with the most views in the last 24 hours. Payment does not affect the order of stories.
10.8 To see listings without personalisation, sign out or choose a different order. You can also object to personalisation, as explained in our Privacy Policy.
11. Extra terms for trade and brand accounts
11.1 This section applies to trade and brand accounts, together with the rest of these Terms. Where they conflict, this section applies.
Your obligations as a trader
11.2 You must comply with consumer protection law when you sell to consumers, including the Consumer Rights Act 2015 in the UK and the Consumer Rights Act 2022 in Ireland. This includes giving accurate descriptions, showing total prices including all mandatory fees, and honouring buyers' legal rights.
11.3 Your business name, address, phone number, logo and website, and your company number and VAT number where given, are shown on your profile and listings so buyers know who they are dealing with. Keep them accurate.
11.4 You are responsible for everyone who uses your account, and for keeping your listings up to date. Reply to enquiries promptly.
11.5 When buyers send you enquiries or messages, you receive their personal data as a separate controller. You must handle it lawfully, use it only to deal with their enquiry, and not add them to marketing lists without their consent.
Data you can access
11.6 You can see the enquiries and messages sent to you, and the number of views, likes and shares of each of your listings. Brand accounts also receive a monthly performance report. We do not give you other users' personal data beyond this. We keep data about how AutoCart is used, which we may use in aggregated form to run and improve the Service.
Google reviews and social media
11.7 If you link a Google business listing, it must be your own. We review each link before showing it. We show the rating and reviews exactly as Google provides them; we do not select, edit or reorder them. You must not post, buy or reward reviews of your business.
11.8 If you connect a Facebook Page or Instagram business account, we post your listings there only when you ask us to. You are responsible for what is posted, and Meta's terms apply to it. You can disconnect the account at any time in the app.
Suspension, termination and changes
11.9 If we restrict or suspend your listings or account, we will email you the reasons at the time, or before it takes effect. You can reply to explain or correct the facts, and we will restore your account without delay if we reverse our decision.
11.10 If we decide to end our service to you entirely, we will give you at least 30 days' notice by email, with our reasons. We may end it immediately, with reasons, where the law requires it, where there is an urgent legal reason, or where you have repeatedly broken these Terms.
11.11 We will email you at least 15 days before any change to these Terms that affects trade or brand accounts takes effect, unless the law requires a faster change. You can close your account before the change applies.
11.12 You can raise any complaint about how we treat your business account at support@autocart.ie. We will consider it and reply with our decision.
Liability to businesses
11.13 If you use AutoCart for business, we are not liable to you for loss of profit, revenue, business, goodwill or data, or for any indirect loss. Our total liability to you for all claims in any 12-month period is limited to the fees you paid us in that period. Nothing in this clause limits liability that cannot be limited by law.
12. Other companies' services
12.1 Google Maps. The AutoCart app includes Google Maps features and content. Your use of Google Maps features and content is subject to the then-current versions of the Google Maps/Google Earth Additional Terms of Service at https://maps.google.com/help/terms_maps/ and the Google Privacy Policy at https://policies.google.com/privacy.
12.2 Google reviews. Ratings and reviews shown on dealer profiles come from Google. We do not write, check or verify them, and they are not AutoCart's opinion.
12.3 Vehicle data. Vehicle details from registration look-ups come from third-party data providers. We do not guarantee they are complete, accurate or up to date, and they are not a substitute for a full history check or inspection.
12.4 Facebook and Instagram. Posting to Facebook or Instagram is subject to Meta's terms and policies.
12.5 App stores. Your use of the app is also subject to the terms of the Apple App Store or Google Play store you downloaded it from.
If you downloaded the app from Apple's App Store
12.6 These Terms are between you and AutoCart only, not Apple. AutoCart, not Apple, is responsible for the app and its content.
12.7 We give you a limited, non-transferable licence to use the app on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
12.8 Apple has no obligation to provide maintenance or support for the app.
12.9 If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
12.10 AutoCart, not Apple, is responsible for dealing with any claims relating to the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, claims under consumer protection or privacy law, and claims that it infringes someone else's intellectual property.
12.11 You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
12.12 You must comply with any third-party terms that apply when you use the app, such as your mobile data provider's terms.
12.13 Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
12.14 Questions, complaints or claims about the app should be sent to AutoCart at support@autocart.ie.
13. Our responsibility to you
13.1 We provide the Service with reasonable care and skill. We do not promise it will always be available, error-free or secure, and we may change, suspend or stop features for good reasons, such as maintenance, security, legal requirements or changes to our business. If we stop a paid feature you have paid for, we will refund the unused part.
13.2 We are not responsible for:
- what other users post, say or do, including their listings, messages and conduct
- any sale, or the condition, description, legality or safety of any vehicle or item
- loss caused by events outside our reasonable control
- loss that was not reasonably foreseeable when you started using the Service
13.3 If you are a consumer, we are responsible for loss you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for business losses.
13.4 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law. Nothing in these Terms affects your legal rights as a consumer.
14. Suspending and closing accounts
14.1 You can stop using AutoCart and delete your account at any time from the side menu in the app.
14.2 We may remove content, limit features, or suspend or close your account if you break these Terms or the law, if we reasonably suspect fraud or a risk to other users, or if the law requires it. We will tell you why, as described in section 7, unless the law or a safety reason prevents us. You can ask us to reconsider.
14.3 If your account is closed, sections 5, 13 and 16 continue to apply.
15. Changes to these Terms
15.1 We may change these Terms to reflect changes to the Service, the law, or how we run AutoCart. We will tell you about important changes in the app or by email at least 30 days before they take effect (15 days for changes affecting trade and brand accounts), unless the law requires a faster change. If you don't agree, you can close your account before the change applies. If you keep using AutoCart after that, the new Terms apply.
16. Law and disputes
16.1 These Terms are governed by the laws of Ireland. If you are a consumer living in the UK, you also keep the protection of the mandatory laws of the part of the UK where you live, and you can bring proceedings in your local courts (England and Wales, Scotland, or Northern Ireland).
16.2 If you are a consumer living in Ireland, you can bring proceedings in the Irish courts. If you use AutoCart for business, the courts of Ireland have exclusive jurisdiction.
16.3 Please contact us first at support@autocart.ie if you have a problem, so we can try to resolve it.
17. General
17.1 If a court finds part of these Terms invalid, the rest continues to apply. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your rights under these Terms to anyone else. We may transfer ours to a company that takes over AutoCart, and your rights will not be reduced.
